Definitions

The 'SELLER' means CHASH The Fine Tea Company Limited. The 'COMPANY' means CHASH The Fine Tea Company Limited.
The ‘Customer’ means any person, firm or company purchasing Goods - including tea and teaware - supplied by CHASH The Fine Tea Company Limited.

Conditions Applicable
Unless otherwise agreed in writing these Conditions shall prevail over any conditions stipulated by the Customer.

1. Prices & Quotations
Any prices quoted may (unless otherwise stated in the quotation) be varied by the Seller without notice.
1.1 Postage
Postage is calculated per the weight and size of the order and its destination. If required, we reserve the right to amend this calculation.
1.2 Currency
Prices shown are in GBP. All transactions on the website will be processed in GBP.
1.3 Customs
For delivery outside the UK, the Customer is responsible for ensuring compliance with the laws of the importing country and for paying all applicable customs duties, import charges and taxes.

2. Cancellation
The Customer shall not be entitled to cancel an order once accepted in whole or in part except by prior agreement with the Seller and against prior payment of a reasonable cancellation charge to be specified by the Seller.

3. Returns
The Customer shall not be entitled to return an order once accepted in whole except by prior agreement with the Seller.

4. Delivery
Goods will be despatched within two business days of ordering. Any delivery date quoted is not guaranteed nor is the time quoted for delivery a condition of the contract. The Seller will not be liable for any failure to meet a delivery date nor for loss or consequential loss of any kind arising from a delay in delivery howsoever caused.

5. Force Majeure
The Company will not be responsible for damage, delays or non-performance directly or indirectly caused by lack of adequate instructions from customers, governmental regulations or requirements, unavailability of material, work stoppages, strikes, slow-downs, boycotts and other causes (whether or not similar in nature to any of those herein before specified) beyond the Company's reasonable control and in such a case may wholly or partially suspend shipment of goods, services or equipment.

6. Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions at any time.

7. Losses
The Company shall not be liable for any damages or any direct or consequential loss of any nature.

8. Intellectual Property
Any original software supplied to the Customer is for use solely by the Customer and is not to be sold, leased or lent to any third party without the express permission in writing of the Company. The Intellectual Property of the Software remains the property of the Company.

9. Use of the website and Your Account
If you use the website, it is your responsibility to maintain the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account.

The customer agrees to accept responsibility for all activities that occur under the customers’ account or password. You should take all necessary steps to ensure that your password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering.

The company reserves the right to refuse access to the website, terminate an account, remove or edit content, or cancel orders at our discretion. If we cancel an order no charge will be made.
You must not use the website in any way that causes, or is likely to cause, the website or access to it to be impaired in any way. Neither may you cause it to be changed or modified in any way.

10. Law and Jurisdiction
These Terms and Conditions and the Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions or to the Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
